Nice shots! Location where you took these looks very similar to the reservoir where I shoot. They love foraging on the dead trees sticking out of the water.
Yes, the first picture the little guy is perched on a tree beside the water, the other shot on a stump in the middle of a pond (same set of ponds). I've also seen them near salt water away from fresh water.
